The provisions of the Streets & Lights policies and procedures are governed by Article IX, A of the Willowbrook Covenants.
Background Information
Article IX, Rights and Obligations of the Association, Section A, The Common Area, states the following: “The Association, subject to the rights of the Owners set forth in this Declaration, shall be responsible for the exclusive management and control of the Common Areas and all improvements thereon (including furnishings and equipment related thereto), and shall keep it in good, clean, attractive, and sanitary condition, order, and repair, pursuant to the terms and conditions hereof”. The street, to include curbs, and the street lights are parts of the common area.
Streets
The Homes Association Board of Directors through the Streets and Lights Committee has maintained the private streets in Willowbrook since they were constructed by the subdivision developer. A portion of the monthly Homeowners dues is placed in a Street’s Reserve Fund to provide the necessary maintenance of the streets. The exact amount of the monthly fees allocated to this reserve fund is determined by the Board of Directors on an annual basis.
Routine maintenance consists of the following:
- The streets are inspected annually and resurfaced on an as-needed basis. Most recently, in 2014, the streets were milled to a depth of approximately 3 inches and repaved with virgin asphalt. Going forward they will be chip sealed approximately every 7 to 8 years.
- During the annual inspection locations which require crack sealing are identified and repaired (typically every 2 years).
- Curbs are repaired or entire sections replaced every 1 to 3 years as needed.
Lights
The streetlights are also maintained by the Streets and Lights committee and are repaired on an as needed basis. Bulb replacement is handled by the committee while more extensive repairs (ballast replacement, wiring faults, etc.) are outsourced to an electrical contractor.
